Updating a story we brought you recently, prosecutors in New Jersey have charged a man operating heavy equipment at a marine terminal in connection to his co-worker’s death.
According to NJ.com, the man, 48, of North Arlington, was allegedly drunk when he was operating a toploader, killing the victim after it struck her on August 7, at the APM terminal in Elizabeth. The man was charged with “single death by auto.”
The victim reportedly had her leg severed and bled to death in the accident. Prosecutors said the man had a blood-alcohol level that was over the legal limit of 0.08 percent when he struck the victim. He now faces a maximum penalty of 10 years in prison upon conviction.
Although criminal charges were filed following the accident, the incident remains under federal investigation through the Occupational Safety and Health Administration (OSHA). A representative for the agency said it could take up to six months for a report to be finalized.
